An active shooter is a person(s) who is either planned or unplanned to kill certain targeted or random numbers of people, usually in a confined area. The consequences of failing to properly prepare for an active shooter or other domestic terrorism incident leave the property owner-operator exposed to tort actions based on “Premises Liability” such as when a person is attacked on someone else’s property (usually a business or commercial property) due to the owner taking inadequate security measures to prevent crime.

Pursuant OSHA’s General Duty Clause, “employers must provide every employee with a safe and hazard-free work environment [29 U.S.C. §654],” employers are being cited for not having prepared for workplace violence. Penalties are on the increase for this violation.
