An active shooter is a person(s) who is either planned or unplanned to kill certain targeted or random numbers of people, usually in a confined area. Failure to plan and train managers and employees on how to respond leaves people to default mental action during an event which most often leads to their making the wrong decisions.

The consequences of failing to properly prepare for an active shooter or other domestic terrorism incident leave the property owner-operator exposed to tort actions based on “Premises Liability” such as when a person is attacked on someone else’s property (usually a business or commercial property) due to the owner taking inadequate security measures to prevent crime.

Pursuant OSHA’s General Duty Clause, “employers must provide every employee with a safe and hazard-free work environment [29 U.S.C. §654],” employers are being cited for not having prepared for workplace violence. Penalties are on the increase for this violation.
